These Terms and Conditions govern the sale of products and services by Anastasia Simon trading as Nourish and Thrive (“we,” “us,” “our”) to the customer (“you,” “your”). By purchasing products from us, you agree to these terms and conditions.

 

1. General Terms

1.1 These terms apply to all sales of products through our website or other agreed methods.
1.2 We reserve the right to update these terms at any time. Changes will be effective from the date they are published on our website.
1.3 By placing an order with us, you confirm that you are 18 years of age or older, or have parental/guardian consent to enter into this agreement.

 

2. Products and Pricing

2.1 All prices are in New Zealand Dollars (NZD) and include Goods and Services Tax (GST) where applicable.
2.2 Prices, product descriptions, and availability are subject to change without notice.
2.3 While we strive to provide accurate product information, errors may occur. If an error is identified after you have placed an order, we will contact you to discuss your options.

 

3. Orders and Payment

3.1 Orders are confirmed once payment is received in full.
3.2 Payment can be made via the following methods:

• Credit or debit card

• Bank transfer

• Afterpay

• Zip Pay
  3.3 If your payment is declined, your order will not be processed.
  3.4 For Afterpay and Zip Pay, you agree to their respective terms and conditions as outlined on their websites.

 

4. Shipping and Delivery

4.1 We ship New Zealand-wide to postal addresses (not PO Boxes).
4.2 Shipping rates are as follows:

• Free shipping on orders of $120 or more or
  
• $10 for Christchurch urban deliveries
• $15 for the rest of New Zealand

4.3 Orders are typically processed within 3 business days. Delivery times vary depending on your location, with most orders arriving within 3–7 business days.
4.4 If your order takes longer than expected, please contact us at hello@nourishandthrive.co.nz and we’ll submit a parcel enquiry on your behalf.

 

5. Returns and Refunds

5.1 Due to the nature of our products, we do not accept returns for change of mind.
5.2 If your product arrives damaged or defective, please contact us within 3 days at hello@nourishandthrive.co.nz. Provide the following images to assist with our investigation:

• Photos of the damaged items

• Photos of the packaging material used

• Photos of the inner and outer packaging

Photos of all barcode labels on the parcel
5.3 If a refund or replacement is approved, we will process it within 7 business days.

 

6. Consumer Guarantees Act 1993

6.1 Nothing in these terms affects your rights under the Consumer Guarantees Act 1993.
6.2 If you are purchasing our products for business purposes, the guarantees under the Act do not apply.

 

7. Liability

7.1 To the extent permitted by New Zealand law, we are not liable for indirect, incidental, or consequential damages arising from the use of our products or services.
7.2 Our liability is limited to the cost of the product(s) purchased.

 

8. Privacy Policy

Refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

 

9. Governing Law

These terms are governed by the laws of New Zealand, and any disputes will be resolved in accordance with New Zealand law.
